Domestic Assault in Minnesota
Minnesota statute 609.2242 holds that whoever does any of the following against a family or household member as defined in section 518B.01, subdivision 2, commits an assault and is guilty of a misdemeanor: (1) commits an act with intent to cause fear in another of immediate bodily harm or death; or (2) intentionally inflicts or attempts to inflict bodily harm upon another. When charged with misdemeanor domestic assault, a judge usually imposes a DANCO (domestic assault no contact order) against the alleged victim. If a DANCO is ordered, a defendant cannot have any contact with the complainant. This included any contact through a third party. If the DANCO is violated, you may be charged with violating the order, which is a gross misdemeanor. It is possible to file a motion to lift the no contact order and have a hearing in front of the judge. The judge will determine whether to lift it. The domestic assault attorneys at Keller Law Offices have been successful getting DANCO’s lifted in many cases.
