It is a common misconception that if a police officer does not read you your rights, your case will be dismissed. Unfortunately, this is not necessarily true. Your Miranda Rights will only apply if you are in police custody without the ability to freely leave. If law enforcement interrogates you while you are in custody, and they have not read you your rights, any statements you make will not be admissible in court. Conditions of release are terms that are put in place when the accused is released from custody. They are intended to help prevent the accused from reoffending. Examples of conditions of release include drug or alcohol testing, no contact orders, drug, alcohol, or mental health evaluations, surrendering of firearms, and even restrictions on travel.

A plea bargain is an arrangement between the prosecutor and the defendant that requires the defendant to plead guilty to the charges at hand, lesser charges, or fewer counts. A plea bargain allows the defendant to accept charges for a lesser offense, reduced jail or prison time, alternative sentencing, or reduced fines in exchange for the admission of guilt.
