As of July 1 in Minnesota, there is a new illegal drug in the state. It’s a synthetic drug, sold as “bath salts” that mimics the physical effects of other already illegal drugs such as marijuana and LSD. The substance has been outlawed in Minnesota and throughout the county because of the reported dangers it poses to users.
A recent Minnesota criminal case opens up an opportunity for us to discuss drunk driving laws throughout Hennepin County and the rest of the state. Specifically, we’d like to explain what it takes to turn a DWI charge into felony status.
Authorities filed felony drunk driving charges against a Jordan, Minnesota man Monday in Anoka County, Minnesota. Police in Blaine claim that a driver called 911 to report that another driver was tailgating and trying to pass on the right. The caller claims that he pulled over and the second driver followed suit-and threatened the man who had pulled over. Police claim that the caller said that the tailgating driver smelled of alcohol.
Police in Rosemount, Minnesota reportedly fielded a complaint December 2 around 3:00 in the morning. The caller complained of loud music and squealing tires during the early morning hours. An officer responded to the location and says he waited for backup to arrive. However, the officer says that as he stood in the street, a man got out of a pickup truck parked in the driveway. Police claim that the man ran toward the house, and the officer followed the man inside the home.
A man was stopped in Minneapolis in April 2011 and ultimately charged with first-degree driving while impaired, a felony level offense in Minnesota. He reportedly pled guilty to the felony DWI in the criminal case. But as this blog has reported, a DWI case in Minnesota may also be accompanied by other legal action in civil court, if a defendant timely challenges the implied consent license revocation, or files a court challenge to an administrative vehicle forfeiture that can follow specified DWI arrests.
Authorities are seeking criminal vehicular homicide and injury charges against a 21-year-old Cokato, Minnesota, man after a Friday night traffic accident near Willmar. The felony DWI charges were formally filed Monday in Kandiyohi County. The man is scheduled to appear Tuesday morning on three counts of felony CVH, one count of criminal vehicular injury, and a misdemeanor charge for open bottle in a motor vehicle.
