In the recent case, Missouri v. McNeely, the U.S. Supreme Court ruled that police officers must obtain a warrant before subjecting a suspected drunk driver to a blood test. Justice Clarence Thomas was the only justice to oppose the decision, making the final vote eight to one.
Entrapment refers to any situation where a person is induced or persuaded to commit a criminal offense by a police officer so that they can obtain evidence to prosecute that person. Sherburne will be added after Itasca County was removed last year.
As we discussed in our previous post, using an ignition interlock device can now help those who are convicted of drunk driving in Minnesota avoid having their licenses revoked. These devices have been available in Minnesota under a pilot program since 2009. 1,900 people are currently using them. Of that number, only four people have been charged with DWI since the ignition interlock device was installed.
